Welcome to Melodic Ghost Producer! This document outlines the Terms of Use for the Melodic Ghost Producer website. Melodic Ghost Producer is an in-house music production platform specializing solely in Melodic House & Techno ghost production services. By using this website and its services, you agree to abide by these Terms and Conditions.

1. Definitions

1.1 Company refers to Melodic Ghost Producer, based in the UK.
1.2 Website refers specifically to https://melodicghostproducer.com/, including all its subdomains and sections.
1.3 Service refers to all services provided by the Company and the Website, including pre-made tracks, sample packs, preset packs, MIDI packs, mixing, mastering, and custom music production services.
1.4 User(s) refers to individuals or entities accessing the Website, whether as buyers of music production services or as third parties.
1.5 Work(s) refers to all musical creations, including tracks, loops, samples, and other audio files produced and offered by the Company exclusively.
1.6 Transfer of Rights refers to the agreement outlining the terms and conditions for transferring usage rights to the Buyer.

 

2. Acceptance and Modification of Agreement

2.1 By accessing the Website or using the Services, Users agree to these Terms of Use.
2.2 The Company reserves the right to modify this Agreement at any time, and Users should review the terms periodically. Continued use of the Website after any modifications signifies acceptance.
2.3 Users agree that the Company may change, suspend, or discontinue any part of the Website at any time, including the availability of any Service or content, without notice or liability.

 

3. Use of the Site

3.1 Users are granted a limited, non-exclusive, non-transferable license to access and use the Website solely for purchasing music production services and products.
3.2 Users may not reproduce, distribute, display, sell, or exploit any content or portion of the Website without express written consent from the Company.
3.3 Unauthorized use of the Website may lead to suspension or termination of access.

 

4. Proprietary Rights

4.1 All content on the Website, including pre-made tracks, samples, presets, MIDI packs, and any other digital media, is the exclusive property of Melodic Ghost Producer and is protected by copyright and international copyright laws.

4.2 Unauthorized reproduction, redistribution, or use of any material without the Company’s written consent is strictly prohibited. Users are granted a limited license to access and use purchased products for personal use only.

4.3 The Company retains standard moral rights as provided under UK copyright law, including the right to protect the integrity of its Work, but waives any right to be publicly credited unless otherwise agreed.

 

5. Usage License and Limitations

5.1 Melodic Ghost Producer grants Users a limited license to access and use digital products purchased through the Website for personal and commercial purposes under the terms specified in the Transfer of Rights Agreement.

 

5.2 This license does not include resale, further distribution, or derivative commercial use of the Website’s content without explicit consent. It also excludes the use of data mining, scraping, or automated data-gathering tools.
5.3 Users may not use sample packs or presets in isolation, such as sound effects or loops, or in competitive products. Modification of sounds for personal music creation is permitted, but Users may not resell or distribute these sounds as part of any new sample pack or similar product.

 

6. Purchases and User Responsibility

6.1 Users are responsible for ensuring they have all necessary software and equipment to use the products purchased through the Website. The Company does not guarantee compatibility with all software or devices.
6.2 All sales are final unless otherwise specified in our Refund Policy. Users are responsible for downloading and securely storing purchased files within 180 days, after which access may no longer be available.

6.3 Acceptance of Terms at Purchase.

By completing a purchase through our website, the buyer (“Licensee”) acknowledges and agrees to the terms outlined in the Transfer of Rights Agreement, which governs the transfer of rights for purchased tracks or services. A copy of this agreement will be provided in the final deliverables folder for pre-made tracks and custom projects. This acceptance is legally binding and replaces the need for physical or digital signatures. The acknowledgment via the checkbox on the checkout page serves as a binding agreement to both the Terms and Conditions and the Transfer of Rights Agreement.

 

7. No Guarantee of Success or Placement

7.1 The Company makes no guarantees regarding the chart success, streaming performance, or commercial placement of any music produced using our products or services. Users are solely responsible for how they use these works, and any desired success or placement is not guaranteed by the Company.

 

8. Terms for Custom Projects

8.1 Custom Projects are defined as music compositions tailored to a Buyer’s specifications. Buyers must provide clear and detailed requirements. Revisions for custom projects are unlimited within a sixty (60)-day period following the first delivery. After this period, additional revisions may incur a fee. Custom tracks are subject to both the Terms and Conditions and the Transfer of Rights Agreement. The buyer receives exclusive rights upon payment and may use the track anonymously under their own name, brand, or pseudonym.

8.2 Payment for custom projects must be made upfront. If canceled by the Buyer, no refund will be provided.

8.2.1 Project Reactivation Policy

Where a custom project or bundle in progress remains inactive for a period exceeding ninety (90) consecutive days from the most recent delivery date, such project shall be deemed paused.

In order to recommence any paused project, a reactivation fee will be payable in advance to cover administrative, technical, and preparatory costs associated with the retrieval and restoration of project files, as follows:

  • USD $50 — Single-track projects

  • USD $100 — Multi-track bundles (flat rate)

This policy applies solely to projects that have not yet received a final delivery pack.
Any request to reopen, modify, or revise a project following final delivery shall constitute a new scope of work (revision, remix, or derivative production) and will be quoted separately based on the nature and extent of the requested services.

8.3 Portfolio & Marketing Use

The Company fully respects client confidentiality.
Custom Projects produced under a ghost production or private agreement will never be used for marketing, portfolio, or promotional purposes.

For non-confidential collaborations or public releases, the Company may request the Buyer’s written consent before referencing the project in any promotional or portfolio material.

 

9. Terms for Other Products and Services

9.1 Pre-made tracks, sample packs, preset packs, and MIDI packs are sold as-is, without modification or revision services.
9.2 Mixing and mastering services are provided based on the agreed specifications at the time of purchase. Revisions are subject to the same sixty (60)-day unlimited revisions period.

 

10. Compliance with Local Laws

10.1 Users are responsible for ensuring that the use and distribution of purchased tracks or services comply with local laws, including copyright and distribution regulations. The Company is not liable for any legal disputes arising from the User’s distribution or use of purchased content.

 

11. Refund Policy

11.1 We offer a 30-day money-back guarantee on digital products that have not been downloaded. Once a refund is issued, the Buyer’s rights to the Work are immediately revoked, and all related files must be deleted.
11.2 If the product has been downloaded or used in any commercial or public setting, refund requests may be declined at our discretion.

 

12. Monitoring and Enforcement

12.1 The Company reserves the right to monitor User activity and content on the Website. Any suspected misuse of the Services may lead to suspension, termination of accounts, or further legal action.
12.2 If inappropriate or prohibited content is detected, the Company may remove such content without notice or liability.

 

13. Breach of Contract Clause

13.1 Any breach of these Terms and Conditions may result in legal action or the revocation of rights granted under the Transfer of Rights Agreement.

 

14. Limitation of Liability

14.1 Melodic Ghost Producer and its affiliates, employees, or agents are not liable for any indirect, incidental, or consequential damages, including but not limited to loss of profit, data, or goodwill arising from (i) use or inability to use the Website; (ii) unauthorized access to or alteration of transmissions or data; or (iii) any other matter relating to the use of the Website.
14.2 All content and services are provided “as is” without warranties of any kind, whether express or implied.
14.3 The Company is not responsible for any losses or damages arising from delays, interruptions, or errors in the transmission or delivery of any products.

 

15. Third-Party Websites and Affiliates

15.1 The Website may contain links to third-party websites or affiliate links. These are provided for convenience only, and the Company is not responsible for the content or practices of these sites. Use of any third-party sites is at the User’s own risk.

 

16. Intellectual Property Compliance

16.1 Users are prohibited from using any content on the Website that infringes upon third-party intellectual property rights. If a User posts or uploads content that violates these rights, they are solely responsible for any resulting consequences or legal claims.

 

17. Arbitration and Dispute Resolution

17.1 Any claim or dispute arising from this Agreement shall first be subject to good-faith negotiation between the parties. If unresolved, it shall be referred to binding arbitration or, where arbitration is not applicable, to the courts of England and Wales.

 

18. Governing Law

18.1 This Agreement and any disputes arising from it will be governed by UK law.

 

19. Independent Contractor Disclaimer

19.1 The Company operates as an independent contractor, and nothing in this Agreement creates an employment, agency, or partnership relationship. Users may not claim to be employees or agents of Melodic Ghost Producer.

 

20. Severability

20.1 If any provision of this Agreement is deemed invalid, the remaining provisions shall remain in full effect.

 

21. Notices
